FAQ-35

To minimize the impact on our trading desk of compliance with the certifications of the Part 2 Application under Association and Confidential Information Rules, would it be possible:  (1) to designate those individuals of the Qualified Bidder in the BGS-RSCP Auction responsible for the preparation and submission of our bids as our “bidding team”; (2) to have the individuals of this bidding team alone make the certifications of the Part 2 Application; and (3) to enforce internally codes of conduct and confidentiality agreements so that the individuals of the trading desk do not share information with the bidding team and vice-versa?


No, that is not possible.

In making the certifications of the Part 2 Application, each Qualified Bidder considers the list of entities that have become Qualified Bidders. The entity becomes the Qualified Bidder, not the individuals who have been tasked internally with preparing and submitting bids in the BGS-RSCP Auction. The “you” in each of the certifications in the Part 2 Application (as in ‘Please certify that “you” are not associated with another Qualified Bidder’) designates the entity that has become the Qualified Bidder.  The ambit of such certifications cannot be restricted to the individuals on the bidding team.
